Criminal investigation looks for stolen money in JP Court

On February 16th, 2010 Judge Lewis's Justice of the Peace Court in Plano collected $8515 in fees and fines. Of that $8515, $5,277 was in cash.

Collin County JP Johnny LewisFor two weeks, the money sat in the JP court office undeposited. Finally on March 8, all the checks and $4,077 in cash were deposited in the county's bank.

$1,200 in cash disappeared and remained unaccounted for until the County Auditor discovered the probable theft in June.

When the auditor's staff arrived on June 8th they discovered a deposit bag from June 2. The money had not been taken to the bank, and there was $586 in cash missing. Another deposit bag from June 4 was also missing $720 in cash.

In all, the Auditor documented $2,506 in missing cash and one lost check for #101.

The Auditor's office believes the money was most likely stolen by an employee, and has turned over the results of the audit to the Collin County District Attorney for investigation. Several high ranking officials at the county confirmed to The Observer that the DA and the Plano police are pursuing a criminal investigation at the JP court.

According to the 2010 County Budget, six people work in the Precinct 3-1 Justice of the Peace Court presided over by Judge Johnnie Lewis.

I checked with the county, there have been no personnel changes in the court in the past 12 months.

So every day, Judge Lewis's court collects fines and fees, much of it from people accused of breaking the law - including for stealing. Then someone in the court steals the fines. That person or persons are still working for our JP court -- still entrusted with collecting money owed to the county.

According to those I've spoken with, the prosecution of the thief has been made much more difficult, maybe made impossible, because of the slipshod way the office was run. Money, which county policy requires be kept secured until deposited in a bank within 24 hours, was left in bags on the floor for up two 2 weeks. Checkbooks were not reconciled, and the deposits were not checked against the day's receipts.

Two prior years of Audits warned the Judge that bank reconciliations were not being done.

Those employees who managed the money and the accounting still work at the court, still report to work every day and are still responsible for accounting for all money. In his response to the Auditor's report, Judge Lewis wrote that "updated policies have been implemented".

I called Judge Lewis and asked him if we could discuss the audit. He told me that he could not because "there was an active criminal investigation of a member of my staff".

According to state law, Judge Lewis is personally responsible for all money entrusted to his court. If the funds are not recovered he will have to repay the county out of his own pocket.

I think that employees who handle money like that are typically bonded - so it is a form of insurance. So, most likely the justice of the peace can probably get the missing money paid by the bonding agency.

But he shouldn't be elected again if he can't figure out how to keep track of this - it ain't that hard. The District Clerk's office takes in A LOT more money than they do - and despite all of their problems, no money is missing.

On the bonding. I'm not sure who is the first person the county will go to, the elected official who is responsible or the bonding company. I would assume that the bond is the relief of "last resort", but I don't know if that is right.

I do seem to recollect a sack of money going missing from the District Clerk's office. It seems like that was 6 or 7 years ago. Anyone remember the details?

Judge Lewis should go ahead and pay the county the missing money asap. In the end, it was his court that he ran in a pathetic fashion. Therefore, he should assume the responsibility and pay the money. It's ironic how the lack of accountability and responsibility issues keep popping up in Collin County...inside the Republican Party. If I remember correctly, accountability and responsibility are primary principles of the Party? Maybe they WERE principles we used to live by...

An effective and efficient Judge would have never found his office under the microscope in the first place. The "controls" to prevent theft should have been in place from day one. Just like all judges tell violators that come thru their courts -- "there is no excuse, the law is the law... guilty... now go pay the clerk at the window"!

Show's he has little respect for the office nor the taxpayers that he represents.
If they cannot settle the matter, charges should be filed.

Okay....justice denied is: justice delayed. He cannot shut down the court; "housekeeping" can be handled correctly. Legislatively, he cannot deny "justice". This IS "the people's court" Where the bulk of our justice occurs. For the uninformed; county court is the other place.

Early next year it will be exposed that Judge Lewis and his assistant Misty Beaty have been involved in hiding incriminating court records unrelated to the current missing money accusations in his highly corrupt office. Unfortunately Judge John L. McCraw will also be involved in this scandal. Rather than release records (required by law) that they promised to release, Judge Lewis somehow convinced the CCCC to hire professional stall & stonewall attorney Robert Davis at substantial expense to CC taxpayers. When Davis realized how much trouble Judge Lewis and his assistant Misty Beaty were in they elected to hide the records, stall and, stonewall. Part of the reason for hiring the stonewall attorney was that the dishonest activities of Misty Beaty and Judge Lewis may have also exposed Collin County to legal action.

Judge Lewis will not run for his next term and may be removed from the bench. Yes it’s that bad.

Judge Johnny Lewis is one of the finest men serving and will make this situation right. There isn't another JP that works harder to help at-risk kids get back on track. I've been an observer in his court, and was so impressed by his professionalism with parents and true commitment to the kids. I know of situations where he made sure there was food on the table, jobs, etc for kids and their families. Don't burn the barn down because of one rat in the office (and it's NOT Judge Lewis).

It's been over 2 months. I smell yet another JP Judge Johnny Lewis sweep-it-under-the-rug performance.. Who is the member of JP Judge Johnny Lewis' staff who is "actively being criminally investigated?" Has JP Judge Johnny Lewis hired another Collin County financed **stonewall** attorney to suppress yet ANOTHER Collin County investigation? Has Lewis’ “staff member” convinced the Collin County Commissioner’s Court to finance another professional stall attorney like Robert Davis to once again keep the less than pleasant facts from the Collin County taxpayers? (..Using our own money of course.)

What state law are you quoting here? Judge Lewis was bonded/insured. the perpetrator must reimburse missing or stolen funds. The Judge of that same court is not obligated to do so and Lewis was not responsible.

I didn't think I'd get an explanation to my question on 3/31/12. FACT: Judge Lewis and his Court were bonded/insured. It is the perpetrator who must reimburse missing or stolen funds. The Judge of that same court is **NOT** obligated to do so as was erroneously quoted above. Although he is an unusually dishonest judge, JP Judge Johnny Lewis was not responsible. FACT: Court Administrator Misty Beaty was the only person seriously investigated and interrogated. Lewis had his wife reimburse the missing funds (even though they were bonded/insured!!). …And now the case is very conveniently marked "Case Closed" by the PPD.
