Commissioners to consider "no bid" contract for Fusion Center

On the agenda for the December 9 Commissioners' court is item #4f2, "Grant exemption from the competitive bidding process...[to] approve a Maintenance Services Agreement with ADB Consulting, LLC for Fusion System Operation and Maintenance for an annual amount of $36,400..."


ADB Consulting is based in Santa Fe, NM. ADB stands for "Anita and Dr. Bob". Its partners are Dr. Robert Johnson and his wife, Anita Miller. They describe themselves as consultants and options traders.

According to check registers published on the county website, Collin County paid ADB consulting $556,123.51 in fiscal year 2008 for consulting, maintenance and software for the North Texas Fusion Center.


The North Texas Fusion Center is an intelligence gathering and data sharing system used in the 16 county North Texas area. It is funded mostly by state and federal grants. The largest grant is the "State Homeland Security Grant" which is financed with federal funds allocated under the "Law Enforcement Terrorism Prevention Program" created by the US Patriot Act.

Dr. Robert Johnson of ADB Consulting is the son of Congressman Sam Johnson. Congressman Sam Johnson voted for the Patriot Act.

It's not surprising that Anita and Dr. Bob's website points to the website of "our favorite congressman" - Congressman Sam Johnson.

Does it surprise anyone that Johnson was previously employed by Collin County as its anti-terrorism guy in 2006? I guess he found it more profitable to move to Arizona (where Sam Johnson has a second home) and set up shop there. Good ol' boy network at work again!

Good job. Bill, do you ever wonder why this kind of investigative reporting isn't done by the Dallas Morning News?

I really don't understand why there would be a request for no competitive bidding. In some areas, there might only be one company that is capable of doing the work, but so what? If only one company bids, fine, why seek out only one bid?

This kind of thing is way too common.

I've read this story again and I don't really see the connection or anything coming close to quid pro quo.

I'm against non-competitive bidding and I would need someone to explain to me why it's necessary. However, I really think pointing out that Sam Johnson voted for the Patriot Act and then trying to tie that to his son's firm through the Collin County Commissioners is silly.

That's not the story. The story is why are the commissioners giving a deal to ADB without competitive bidding?

Now, if Sam Johnson gave money directly to his son like Charles Rangel recently did, that would be a story. If Sam Johnson got a sweet loan from Countrywide like Banking Committee head Charles Dodd did, that would be a story.

The non-competitive bid to the son of a local congressman is the story. The rest is interesting, but the story is the use of influence to stifle even the chance at fair competition for public service money. If a county commissioner's child got a no bid contract from a city in the county that had business with the county, we would be outraged at the commissioner and the mayor, where is the outrage when the same thing happens on a higher level with more $ at stake? If this county were a little more purple, this sort of story would be all over the news.

The Patriot Act is the only thing Bill brought up, and that's a bit of a stretch. 357 House Representatives and 98 Senators voted for the Patriot Act. So with that logic, anyone who voted for the recent $700 billion dollar "stimulus" who has any relatives in the banking or financial or automotive sector is unethical? So if Sam Johnson voted for this stimulus package and his son owns an auto dealership, that's unethical? Give me a break.

If the implication of this article is that Sam Johnson has influenced the county to give his son business, I'll need to see a single shred of evidence on that. Something a bit more substantive than The Patriot Act.

It's the no-bid deal that irks me. I'd like to hear the reasoning for that.

My opinion is that the relationship is more insidious than that. Perhaps this is so everywhere but I don't know that. I know it is a problem in Collin County.

It appears to be accepted practise to "help" the relatives of prominant Collin County politicians, regardless of whether they are local, state. of federal officials. This has gone on for years and most are involved. I think this relationship with Sam Johnson's son is very concerning but no more than many. We have got to start asking our officials about these issues publically.

He has no authority over the commissioners. He doesn't control the purse strings for funding for the county of any kind. There is no reason at all why any county leader would feel compelled to listen to Sam Johnson even if the man picked up the phone and asked them to give a no-bid contract to his son, which is completely unsubstantiated.

If that is what you are implying, you need a single bit of evidence before you publicly imply that's what is going on. And I wouldn't be willing to do that myself since people are being sued for libel with comments like that on the Internet. If you are going to smear a man's character in public, you better have something to back it up.

You can't accuse someone of doing something seemly without evidence.

I don't think bill cross a line here and made any inappropriate allegations.

First, Sam Johnson is a public official. They have a higher degree of scrutiny than 'run of the mill' folks. Courts have held over and over that in order for public officials to prevail on a claim of libel: 1) The offender had to KNOW the information was false, 2) The offender had to INTENTIONALLY release the information in an effort to damage the person of the public official (not the public office), and 3) There has to be an actual damage. Of course, the public official claiming libel would have the burden of proof. I don't think Johnson could do this.

Secondly, you must admit that it is suspicious and leaves a 'not milk and honey' taste in your mouth that the son of a congressman living two states away happens to have a multi-million dollar non-competitive governmental contract in his father's congressional district. While I am all for the burden of proof and evidence, in dealing with PUBLIC matters suspicious circumstances ought to be scrutinized. Besides - no charges have been made, just questions raised and implications. That is more than fair in a democracy.

Finally, to assume that Sam Johnson doesn't have influence in county politics displays a lack of understanding in the political process. U.S. Congressman have a great deal of influence in their communities. Johnson practically endorsed Self's campaign for county judge. He also publicly endorsed Kathy Ward for county commissioner. Is Johnson making quid pro quo phone calls? We'll likely never know. But do public officials take his phone call in a heartbeat? You bet.

I normally agree with your, Mr. Walters, but in this argument I think you are discounting Johnson's influence and refusing to recognize that we have a set of circumstances that don't seem to be in the interest of the public.

Just my thoughts....

And "it's no surprise" that Anita and Dr. Bob's favorite congressman is Sam Johnson because Sam is his dad. The implication Bill puts forth that he's their favorite congressman because he voted for The Patriot Act which created federal funds that went to the state that went to the county that went to ADB, and that's absurd.

Sam Johnson endorsed Kathy Ward. So what? So did Ralph Hall. Does that mean Ralph Hall, whose district is the majority of Collin County, can "get money from the county" too?

Is that all you have? An endorsement is Sam's influence?

ADB Consulting got a contract last year, right? Was that a no-bid contract or not? It was for over $500,000 worth of service and software, right? OK, what was the bidding process for that? That is key.

2009's proposal is for $36,400, a huge decline from 2008's figure. Has anyone considered that maybe this $36,400 is a continuation of 2008's work and that is why it's proposed to be no-bid? Has anyone thought about shooting off an email and asking?

How did they vote anyway? The meeting was 3 days ago. Or was this just another drive-by accusation?

I really do understand your points, and I am not alleging that anything unlawful or unethical took place. But, I do think its fair to say that Sam Johnson has a lot of power in this county - not just through endorsements, either.

I think what really happens in these cirucmstances is you have a relatively few people "running" things, and it naturally becomes cycle-like in the provision of services and contracts, if for nothing else that governments often do business just like the private sector - with people they know.

The summary of my argument is that Bill didn't make any accusations that crossed the line.

"In the case of North Central Texas, for example, the Fusion System team boldly held conferences, established websites and sought Congressional funding in the name of the region."

The "Fusion System Team" is Kelley Stone, Dr. Bob Johnson and Anita Miller.

So if the question is, Did Sam Johnson vote for the Patriot Act so his son and daughter-in-law could make a lot of money? My guess is that that answer is, "no".

But if you ask, Was Dr. Bob Johnson so well connected that he was in an excellent position to gain the inside track to a 'sole source' contract and help secure the funding for that contract?, then the answer is going to likely be "yes".

If you then ask, Did the Congressman act to enhance his son's work and opportunities? Then again, it sure looks like you'd have to answer, "yes".

Also, the funding you speak of isn't controlled by Sam Johnson. It's controlled by some Democrat since they head all the committees in Congress.

Saying Sam voted for the Patriot Act was silly.

Does a "maintenance" contract mean they are maintaining the software they designed and installed from the previous ~$500,000 contract? Was that no-bid? If not, there is no issue here.

I have clients where I create a Web site or an animation for them. Later, they want me to maintain it or make changes to it. Who do you think is going to do that? Me, of course.

I'm just trying to get ALL the facts before judging.
